  12. 1. Hesed Interactive ("Hesed") grants to
  13. you a non-exclusive, non-sublicensable,
  14. license to use this computer software
  15. product (the "Software"), in binary
  16. executable form on a single computer
  17. for fourteen (14) days from the date you
  18. obtained this trial version.

  20. 2. HESED MAKES NO REPRESENTATIONS ABOUT
  21. THE SUITABILITY OF THIS SOFTWARE OR ABOUT
  22. ANY CONTENT OR INFORMATION INCLUDED WITH
  23. THE SOFTWARE, FOR ANY PURPOSE.  THE
  24. SOFTWARE IS PROVIDED 'AS IS' WITHOUT
  25. EXPRESS OR IMPLIED WARRANTIES, INCLUDING
  26. WARRANTIES OF MERCHANTABILITY AND FITNESS
  27. FOR A PARTICULAR PURPOSE OR NONINFRINGE-
  28. MENT.  HESED SHALL NOT BE LIABLE UNDER
  29. ANY THEORY OR ANY DAMAGES SUFFERED BY YOU
  30. OR ANY USER OF THE SOFTWARE.

  34. and is protected by applicable copyright law.

  39. 4. Title, ownership rights, and intellectual
  40. property rights in and to the Software shall
  41. remain in Hesed and/or its suppliers.  You agree
  42. to abide by the copyright law and all other
  43. applicable laws of the United States including,
  44. but not limited to, export control laws.  You
  45. acknowledge that the Software in source code
  46. form remains a confidential secret of Hesed and/or
  47. its suppliers and therefore you agree not to
  48. modify the Software or attempt to decipher,
  49. decompile, disassemble or reverse engineer the
  50. Software, except to the extent applicable laws
  51. specifically prohibit such restriction.

  53. 5. Hesed may terminate this License at any time
  54. by delivering notice to you and you may terminate
  55. this License at any time by destroying or erasing
  56. your copy of the Software.  Upon termination of this
  57. License, you agree to destroy or erase the Software.
  58. In the event of termination, the following sections
  59. of this License will survive: 2, 3, 5, and 7.  This
  60. License is personal to you and you agree not to
  61. assign your rights herein.  This License shall be
  62. governed by and construed in accordance with the
  63. laws of the State of California and, as to matters
  64. affecting copyrights, trademarks and patents, by U.S.
  65. federal law.  This License sets forth the entire
  66. agreement between you and Hesed.

  68. 6. HESED OR ITS SUPPLIERS SHALL NOT BE LIABLE
  69. FOR (a) INCIDENTAL, CONSEQUENTIAL, SPECIAL OR
  70. INDIRECT DAMAGES OF ANY SORT, WHETHER
  71. ARISING IN TORT, CONTRACT OR OTHERWISE, 
  72. EVEN IF HESED HAS BEEN INFORMED OF THE 
  73. POSSIBILITY OF SUCH DAMAGES, OR (b) FOR ANY
  74. CLAIM BY ANY OTHER PARTY.  THIS LIMITATION
  75. OF LIABILITY SHALL NOT APPLY TO LIABILITY FOR
  76. DEATH OR PERSONAL INJURY TO THE EXTENT
  77. APPLICABLE LAW PROHIBITS SUCH LIMITATION.  
  78. FURTHERMORE, SOME STATES DO NOT ALLOW
  79. THE EXCLUSION OR LIMITATION OF INCIDENTAL
  80. OR CONSEQUENTIAL DAMAGES, SO THIS LIMITA-
  81. TION AND EXCLUSION MAY NOT APPLY TO YOU.
